Agreement to these terms
By creating a FlipQuix account or using FlipQuix, you agree to these Terms of Service and acknowledge our Privacy Policy. If you don't agree, please don't use FlipQuix.
Eligibility and age
You must be at least 13 years old to use FlipQuix, and old enough in your jurisdiction to form a binding contract, or have a parent or guardian's permission. If you're using FlipQuix on behalf of a business, you're confirming you have authority to agree to these terms for that business.
Your account
You're responsible for keeping your account credentials secure and for activity that happens under your account. Provide accurate information when you register, and tell us if you suspect unauthorized access.
Acceptable use
Use FlipQuix for its intended purpose: scanning, researching, and organizing your own items. Don't use it to violate the law, infringe others' rights, upload content you don't have the right to share, abuse the service, attempt to bypass its security or rate limits, or interfere with its normal operation.
Photos you upload
You own the photos and information you submit, and you're responsible for having the right to share them. By uploading a photo, you grant FlipQuix a limited license to process, store, and display that photo back to you as part of providing the service — including sending it to our AI processing provider for identification and valuation. This license ends when you delete the photo or your account, subject to the retention limits described in our Privacy Policy.
QuixVision identification and value estimates
FlipQuix's identification, condition assessment, rarity signals, and value estimates are generated by AI analysis of your photos, informed by comparable sale information. They are a research starting point, not a professional appraisal, an authentication, a guarantee of condition or authenticity, a guaranteed sale price, or investment, tax, or legal advice. AI analysis can be wrong, especially for items requiring specialist authentication or expertise. You are responsible for independently verifying identity, condition, authenticity, legality, and value before making buying or selling decisions, especially for valuable items.
Item Profiles, History, and Inventory
Item Profiles, History entries, and Inventory records reflect the information available at the time you scanned or entered an item. They are your own organizational records, not a certified appraisal or a guarantee that any listed value remains accurate over time.
Buying and selling responsibility
Decisions about buying, selling, pricing, or otherwise acting on any FlipQuix estimate are entirely your own. FlipQuix is not a party to any purchase or sale you make based on information from the app, whether that transaction happens on a connected marketplace or elsewhere.
Marketplace connections and listings
When you connect a marketplace (such as eBay, Etsy, or Shopify) and publish a listing, that listing and any resulting sale are governed by that marketplace's own terms, fees, and policies, in addition to these terms. You are solely responsible for the accuracy of your listings, the legality of what you sell, shipping, returns, applicable taxes, and complying with each marketplace's prohibited- and restricted-items policies. Plants, live goods, and other regulated or restricted items may be subject to additional marketplace, agricultural, or shipping-destination rules — FlipQuix helps prepare a listing but does not guarantee any item is eligible for sale on any given marketplace or destination.
Direct marketplace publishing (creating a live listing on a connected marketplace) is not currently active. Sell Item and Sell Credit purchases may be active in some environments and are billed through Stripe when used; where either feature is not active in your environment, it is clearly marked as unavailable in the app and no payment is charged.
Marketplace sale proceeds
Marketplace sales and payouts are completed through the connected marketplace under that marketplace's own payment and payout terms. FlipQuix does not currently receive, hold, or transmit marketplace sale proceeds on your behalf.
Subscription plans, pricing, and promotions
Paid plans are billed at the price shown at checkout and renew automatically each month at that same price until you cancel. FlipQuix does not offer promotional or discounted first-month pricing — the price you consent to at checkout is the price charged for the first period and every renewal.
Locked-in pricing: your monthly price stays the same as long as you keep your paid subscription continuously active. Canceling, letting your subscription lapse, or switching plans ends locked-in pricing; if you subscribe again, the pricing in effect at that time applies.
Business subscriptions
Inceptum and Enterprise are organization subscriptions billed monthly to the purchaser who completes checkout. Before purchase we require two separate confirmations: that you are authorized to buy on behalf of the organization, and that you expressly agree the plan renews automatically each month at the displayed price until cancelled.
Each plan includes a fixed monthly scan allowance and a maximum number of user seats, as shown at checkout. Access, allowances and seats end when the paid period ends after cancellation.
Cancellation, refunds and billing errors for Business plans are covered by our Refund Policy.
Cancellation
You can cancel any time from Profile → Manage Subscription, which opens Stripe's billing portal. Canceling stops future renewals; your access continues through the end of the period you already paid for. No partial-period refund is issued for cancellation itself — see our Refund Policy for other situations that may qualify.
Scan allowances, Top-Offs, and Sell Credits
Each plan includes a monthly scan allowance that resets on your billing date; unused scans do not roll over to the next period. Scan Top-Offs are one-time purchases of additional scans that do not expire. Sell Credits, when active, are a limited, non-transferable service credit that entitles you to one Sell Item listing-preparation action per credit — they have no cash value, cannot be redeemed for cash, transferred to another account, or withdrawn, and are not a deposit, investment, or stored balance. Where FlipQuix currently promises Sell Credits never expire, that promise applies only once Sell Credit purchases are active and is honored for credits actually issued.
Failed payments
If a payment fails, we may retry it and may suspend access to paid features until payment succeeds or you update your payment method through the billing portal.
Refunds and chargebacks
Refund eligibility is described in our Refund Policy. Initiating a chargeback instead of contacting us first may result in suspension of your account while the dispute is resolved.
Intellectual property
FlipQuix's name, logo, QuixVision branding, and app design are owned by FlipQuix LLC. You don't get any ownership rights in them by using the app.
Copyright (DMCA)
If you believe content on FlipQuix infringes your copyright, contact legal@flipquix.com with a description of the work, the allegedly infringing material, and your contact information, and we will respond in accordance with applicable law.
Third-party services
FlipQuix relies on third-party services — including Stripe for payments, Supabase for authentication and storage, Anthropic for AI processing, and connected marketplaces — to operate. We aren't responsible for those providers' own outages, errors, or policy changes, though we work to keep FlipQuix functioning reliably.
Suspension and termination
We may suspend or terminate access for violations of these terms or misuse of the service. You can stop using FlipQuix and cancel your subscription at any time.
Service changes and availability
We aim for FlipQuix to be reliably available but don't guarantee uninterrupted access. Features may change, be added, or be removed, and the service may occasionally be unavailable for maintenance or due to circumstances outside our control.
Disclaimers
FlipQuix is provided "as is" and "as available." To the extent permitted by applicable law, we disclaim warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, beyond what applicable law makes non-waivable.
Limitation of liability
To the extent permitted by applicable law, FlipQuix and FlipQuix LLC are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the service. Our total liability for any claim relating to FlipQuix is limited to the amount you paid us in the twelve months before the claim arose, or $100 if you haven't made a payment, whichever is greater. Nothing in these terms limits liability that cannot be limited under applicable law.
Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold FlipQuix LLC harmless from claims arising out of your violation of these terms, your misuse of the service, or content you upload, except to the extent caused by our own breach of these terms or violation of law.
Governing law and disputes
These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. FlipQuix does not currently require arbitration or a class-action waiver for disputes — if that ever changes, it will be a deliberate, clearly disclosed update to these terms, not a silent one.
California consumer rights
Nothing in these terms limits any right or remedy available to California consumers under applicable law, including automatic-renewal disclosure and cancellation requirements.
Severability
If any part of these terms is found unenforceable, the rest remains in effect.
Changes to these terms
We may update FlipQuix and these terms as the product evolves. We'll update the effective date at the top of this page when terms materially change, and where required by law, provide additional notice.
